The DHS is continuing to work on the attendee list and responses to the 317 questions from the Industry Day. The attendee list and answers to the questions will be provided once available. Additionally, the final RFP will not be posted until after the Thanksgiving holiday. The DHS will inform Industry of the anticipated date the final solicitation will be released once it is determined.

10/27/2023 - 

The third PACTS III draft Request for Proposal (RFP) and attachments have been posted and include “3rd Draft RFP” in the naming convention. The Government is not accepting any questions or concerns regarding any aspect of this draft solicitation.

Note: The final RFP for PACTS III will consist of three (3) separate solicitations, one (1) for each Functional Category. This third PACTS III draft RFP is only for Functional Category 1. The solicitations will look similar except for the one sentence under PART I – Continuation of SF 1449 that states which Functional Category the specific solicitation pertains to.

Many aspects of the draft RFP were revised from the second version to the third, so we encourage Industry to read it and all the attachments in its entirety. Some of the major updates include but are not limited to:

1) Offeror’s proposal will be evaluated based on the Functional Category, socioeconomic track and type of Offeror;

2) Projects that meet the definition of relevant and recent as defined in the solicitation that are from the Offeror (Prime Contractor or Small Business Teaming Arrangement (SBTA)) itself or a partner/member of the Offeror’s SBTA will be considered;

3) 40% of projects verified must have been performed by the partner(s) of the joint venture that possess the socioeconomic status associated with the track the Offeror is proposing (52.207-6(a)(1)(i)); Prime Contractor of a Prime/Subcontractor relationship (52.207-6(a)(1)(ii)) or the protégé in a Mentor-Protégé relationship (52.207-6(a)(2);

4) Majority of the attachments were refreshed;

5) The Government intends to use the Procurement Integrated Enterprise Environment (PIEE) suite for proposal submission and retrieval;

6) Managing Venturers or Prime Contractors of SBTAs that are Joint Ventures or Prime/Subcontractor(s) as defined in the solicitation may be granted additional points if Partner/Subcontractor agreements are provide that prove the Offeror has managed teams of the same size or larger on other projects.

The DRAFT documents and language within this third draft RFP are subject to change. Should any language in the DRAFT documents conflict with the final issued RFP, the final RFP shall take precedence.

The PACTS III Industry Day will be held on November 9, 2023, from 10:00am to 12:00pm EST. The Government is using Microsoft Teams Live to conduct this Industry Day. To participate, guest should copy and paste the link below in their browser.

All questions or concerns regarding any aspect of this draft solicitation shall be submitted using the Solicitation Question and Answer Form, Attachment 17 and sent to PACTSIII@uscis.dhs.gov no later than 5:00 pm Eastern Time on July 7, 2023.

Many aspects of the draft RFP were revised from the first version to the second, so we encourage Industry to read it and all the attachments in its entirety. Some of the major updates include but are not limited to:

1) Past performance evaluation has been included.

2) Projects will only be considered from Primes (w/o subcontractors or affiliates), SBA Small Business JVs, SBA MPPs itself or members of SBA Small Business JV or SBA MPP. Although Small Business Teaming Arrangements may submit a proposal, only projects from the Prime of that arrangement will be accepted. Projects from the members of a Small Business Teaming Arrangement will not be accepted.

3) 40% of projects verified must have been performed by the Protégé in an SBA MPP.

4) The second draft RFP further defines Project Relevancy/Recency requirements and “Offeror”, “Proposal”, and “Contract” (Ref. Revised Qualifying Project Examples, Atch. 14).

5) Updated the Statement of Work, On/Off Ramping Terms and Conditions and Attachment 2

6) Added Attachments 3, 11, 19-22

4/24/2023 Update - DHS is continuing to work on responses to the questions from the initial draft RFP and will provide responses once available. DHS anticipates a second draft RFP to be released. The virtual Industry Day will no longer be at the end of March 2023 and has tentatively been rescheduled for the end of April 2023. Each quote submitted will be evaluated separately. (f) Late submissions, revisions, and withdrawals of quotes. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotes are due. (2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotes is "late" and may not be considered unless it is received before purchase order issuance and the Contracting Officer (CO) determines that accepting the late quotation would not unduly delay the acquisition. The General Services Administration (GSA) intends to construct a new fully functional Land Port of Entry (LPOE) at Highgate Springs, Vermont. The government will utilize the "Construction Manager as Constructor (CMc)", also known as "Construction Manager at Risk" or "Guaranteed Maximum Price (GMP)", delivery method. The CMc project delivery method includes requirements for the Design Phase Services and the Options(s) for Construction Services at a Guaranteed Maximum Price (GMP). The project shall adhere to the GSA Design Excellence and Operational Excellence guidelines, the GSA PBS Facilities Standards for the Public Buildings Service (P100) 2021 with 2022 addendum and is targeted to achieve USGBC LEED Gold and SITES Silver.

Constructed in 1997, the Highgate Springs LPOE is at the northern end of U.S. Interstate 89 (I- 89), approximately 40 miles north of Burlington, VT, and opposite the Canadian port of entry at St. Armand/Philipsburg, Quebec. Canada is in the process of completing construction of Autoroute A35 between Montreal and the Canada/U.S. border. Canada in coordination with Vermont’s Agency of Transportation (VTrans) is converting Route 133 into a multilane highway, which would link Montreal to the US border with a continuous multilane highway system.

When completed, traffic is estimated to increase by as much as 30% at this port of entry. Canada is targeting for a 2025 substantial completion on the final highway segment.

The existing site occupies approximately 16.1 acres and includes seven buildings totaling approximately 44,000 GSF. The site is bounded to the north by the U.S./Canada border, to the east by the northbound lanes of I-89 and rock outcroppings and bluffs, to the south by the former site of the State of Vermont’s Welcome Center, and to the west by privately owned land. Lake Champlain is about 1/2 mile to the west. Tenants include the U.S. Department of Homeland Security’s (DHS) Customs and Border Protection (CBP); the Food and Drug Administration (FDA); the U.S. Department of Agriculture’s (USDA) Animal and Plant Health Inspection Service (APHIS), and GSA.

This project will construct a new fully operational Land Port of Entry at Highgate Springs with expanded capacity to alleviate the increase in commercial and personally owned vehicle (POV) traffic expected for the completion of the Canada AutoRoute A35 project.

The main goal is for this project to provide a new LPOE for CBP, FDA, APHIS, and GSA. Anticipating a May 2028 completion date, this will meet each agency’s requirements and allow them to operate efficiently under the increased traffic volume estimated after Canada Autoroute A35 is completed. Buildings and traffic patterns will be arranged to facilitate a smooth traffic flow, ease congestion, and enhance security for each agency, while providing a welcoming gateway into and out of the United States. Another GSA goal for the project is to complete the design and construction efficiently and effectively and to keep the project on time, on budget, within scope, on quality, and code compliant. The process will adopt an integrated design approach engaging all team members from CBP, FDA, APHIS, GSA, and impacted property owners. This approach shall extend through all phases of the design of the project and through its construction. Building Information Modeling (BIM) will be used throughout the project to ensure the integration of all aspects of the project. In addition to constructing a new port for its tenants, GSA will coordinate its project with others in the immediate vicinity: Canada Autoroute A35, the renovation of the Canada Border Services Agency’s (CBSA) port at St. Armand/Philipsburg, and the construction of a new truck inspection facility for the State of Vermont’s Agency of Transportation. The new LPOE will need to be constructed in a way that allows the existing port to remain in operation throughout the construction.

The design phase services shall be performed at a firm-fixed-price and the optional construction services shall be performed at a Guaranteed Maximum Price (GMP). This solicitation will be executed pursuant to Federal Acquisition Regulation (FAR) Subpart 15.101-1, Best value continuum, Trade-Off process and FAR Subpart 15.202, Advisory multi-step process. Pursuant to FAR Clause 52.215-1 Instructions to Offerors-Competitive Acquisition, the Government intends to evaluate proposals and award contracts without discussions with offerors (except clarifications as described in FAR 15.306(a)), although it reserves the right to open discussions should it be determined to be in its best interests. It is the government’s intention to award a contract to the offeror whose proposal conforms to the RFP requirements and is considered to be the most advantageous to the government, price and technical factors considered. Competitive proposals shall be evaluated and assessed based on the factors specified in this solicitation. For this solicitation, the combined weight of the non-price factors is approximately greater than price.

One (1) award will be made from this two-step (2-Step) CMc solicitation. This procurement will be solicited as full and open competition.

The North American Industry Classification System (NAICS) code for this acquisition is 236220 (Commercial and Institutional Building Construction). The small business size standard is $39.5 million average annual receipts.

Competitive proposals shall be evaluated based on the factors specified in the solicitation. This procurement will follow the advisory multistep process in accordance with FAR 15.202. It is anticipated that the non-price technical factors will be broken down by phase, as follows:

Phase 1:

  1. Experience in Providing Design Phase Services and Construction Phase Services on Similar Projects (30%)
  2. Management and Technical Approach (Design Phase Services and Construction Phase Services) (20%)
  3. Qualifications and Experience of Key Personnel (15%)

Upon completion of the evaluation of Phase I proposals, an advisory shortlist will be developed. All offerors will be notified as to whether their firm was included on or excluded from the advisory shortlist. It shall be noted that exclusion from the advisory shortlist shall not preclude offerors from submitting a Phase II proposal.

Important Notes: (1) A bid guarantee will be required ninety (90) calendar days prior to the exercise of the GMP Option for Construction Services. The Contractor shall furnish required performance and payment bonds within fourteen (14) calendar days of exercise of the GMP Option. (2) In accordance with FAR 30.101, Cost Accounting Standards, the Contractor must demonstrate their compliance with Cost Accounting Standards. Award shall not be made to any contractor that is not CAS compliant.

The estimated total construction cost for the project falls within the range of $110,000,000.00 and $130,000,000.00.

Award is anticipated to be made for design phase services, with Options 1 and 2, to be available for award at a later date as needed.

Design phase services are anticipated to commence upon award of the contract on or about August 2024. The Optional Construction Phase Work is anticipated to be awarded on or about Spring 2026, with a performance period for the Design Phase of approximately 730 calendar days and Construction Phase approximately 838 calendar days. Offerors shall note that while the total project budget has received Congressional authorization, it has yet to be fully appropriated.

The Contractor shall provide performance assessments from contracts for five of those VHA facilities, as well as evidence that the services were conducted in accordance with Boiler Efficiency Institute (BEI) guidelines. Technician Qualifications Contractor shall employ qualified preventive maintenance technicians to perform the services described herein. Qualified means a technician shall have successfully completed at least one year of trade school in a relevant course of study and shall have five years of experience with institutional and/or industrial boiler service at plants similar in design to the WRJVAMC boiler plant. Technicians shall have experience with and knowledge of fire tube boilers and Fireye flame safeguard and combustion controls. The WRJVAMC facility manager or engineer may define and accept equivalent qualifications. Technicians shall demonstrate familiarity with and ready access to the current versions of the following references: NFPA 85, Boiler and Combustion Systems Hazards Code VHA Boiler and Associated Plant Safety Device Testing Manual. Technicians shall be equipped with portable electronic flue gas analyzers and other test instruments necessary for the required tests and calibrations, all calibrated within one month of the site visits. At facilities with programmable digital controls, the technicians must be capable of programming the controls and have the appropriate hardware and software for this. All Contractor employees performing work at WRJVAMC shall be trained in and shall follow proper VA lock out / tag out procedures. Regular Service Requirements The Contractor shall provide all qualified technician labor, equipment, tools, materials, parts, supplies, transportation, supervision, any other items, and non-personal services deemed necessary to perform the regular services for semi-annual preventive maintenance and annual inspections, including tuning, testing, calibrating, and adjustments on Boilers #1, #2, and #3 and on all burners and boiler plant controls at the WRJVAMC. Contractor shall: Conduct all testing in accordance with the VHA Boiler and Associated Plant Safety Devise Testing Manual (Attachment 2). All testing must be documented in a fashion acceptable to the VA. Perform combustion analysis of boilers under gas and fuel oil operation and calibrate fuelto-air mixture at the facility. Install all control parts for all three boilers. All used parts are to be turned over the WRJVAMC for disposition evaluation. Test and record the operation and set points of all burner/boiler safety interlock devices. Verify that the set points and operating points are within approximately 20% of normal operating parameters. Make all adjustments as necessary and record the new settings. Supply copies of the BEI paperwork to the WRJVAMC Boiler Plant Supervisor and Contracting Officer s Representative (COR) upon completion of inspection and testing, in accordance with BEI testing procedures. The operation of a safety interlock device must result in burner shutdown and/or proper alarm operation. All interlocks and safety devices to be inspected and tested on each boiler, burner, and related equipment are contained in the most current revision of the VHA Boiler Plant Safety Devices Testing Manual along with testing procedures. This maintenance shall be done every six months in accordance with a schedule provided by WRJVAMC facilities staff. Contractor shall cover all costs for calibrations of gauges, transmitters, flow meters and controls including all shipping, handling, and postage. Boiler Tuning Requirements Contractor shall perform boiler tuning to meet or exceed the following minimum requirements, and shall provide all combustion analyzers (Calibrated) as well as performance data indicating these requirements have been met or exceeded: Required burner performance (natural gas and fuel oil): Turndown (ratio of maximum and minimum of firing rates) 10/1 and 8/1 respectively. Achieve, but do not exceed, boiler maximum steam flow output rating. Measure fuel input at minimum and maximum firing rates. Maximum Carbon Monoxide: 200 PPM throughout the firing rate. Flame shall be stable, with no pulsations, shall be retained near burner, no blowoff or flashback, no constant impingement on refractory or water tubes. No visible smoke; must comply with local emissions regulations. Must follow all Boiler Efficiency Institute (BEI) guidelines (provided locally). Flue gas oxygen: 2.5 4.2% O2 (Up to 5.2% at loads below 40% of maximum steam output, no upper limit at minimum firing rate, oxygen can be 1% point higher on oil firing on singlepoint positioning systems). In an emergency such as an event that jeopardizes VA N+1 boiler redundancy requirements, an emergency service call will be initiated by a WRJVAMC boiler plant operator or facilities engineer to the Contractor s service center via telephone, email, and/or text messaging. Contractor shall acknowledge the call for emergency service within 4 hours, shall provide support by qualified technicians on site within 8 hours, and shall endeavor to return equipment to normal operation within 24 hours. Normal operation means that defective parts have been replaced with parts that meet or exceed manufacturer's original specifications and VA requirements, and that the equipment meets or exceeds the manufacturer's original performance specifications. During regular preventive maintenance, the contractor shall recommend long-lead-time critical parts that the VA facility should keep in supply to avoid service disruption. The Contractor shall replenish any VA inventory consumed in the course of preventive maintenance or emergency service. For emergency calls/service the contractor will furnish all Factory repair parts and service not to exceed a TBD amount per year. The U.S. General Services Administration (GSA) Art in Architecture Program commissions American artists (citizens and Lawful Permanent Residents or Permanent Workers of the United States) to create publicly scaled and permanently installed artworks for Federal buildings nationwide.

GSA announces an opportunity for a federal art commission in conjunction with the new construction of a new Highgate Springs Land Port of Entry (LPOE) in Highgate Springs, Vermont.

GSA is working with its tenant agencies: U.S. Customs and Border Protection (CBP), U.S. Food and Drug Administration (FDA), and the USDA Animal & Plant Health Inspection Services (APHIS) – to design and construct a new facility capable of handling the increased traffic at the port of Highgate Springs LPOE, which is located in Highgate Springs, VT, across the U.S.-Canada border from St. Armand, Quebec and adjacent to Lake Champlain.

The existing 44,000 sq ft Highgate Springs LPOE operates 24/7 at the border crossing between the multilane U.S. Interstate-89 (I-89) and Canada Route 133 to Montreal. Following completion of Canada's A35 highway project, traffic volume is projected to increase by 30% at the Highgate Springs LPOE border crossing, requiring a larger facility of approximately 116,000 sq ft.

With the completion of the project, the building will apply for Leadership in Energy and Environmental Design (LEED) gold certification.

GSA allocates one-half of one percent (0.5%) of the estimated construction costs of new or modernized Federal facilities for art commissions.  The art budget for the new Highgate Springs Land Port of Entry (LPOE) in Highgate Springs, Vermont project is estimated to be $500,000. One or more artists will be awarded a fixed-price contract for a commission.

Artists who wish to be considered for this GSA art commission must submit application materials to GSA by the SAM Contract Opportunity’s Response Date.  Artists may also elect to be considered for all future GSA art commissions by submitting application materials to GSA’s National Artist Registry (Registry).  Instructions on how to submit application materials and join the Registry are available on the following Web site:

All artists who wish to be considered as candidates for a commission at the new Highgate Springs Land Port of Entry (LPOE) in Highgate Springs, Vermont, must have their application materials submitted and received by GSA by 5:00 PM Eastern Time on 1/3/2025.  Artists’ submissions received after the deadline will not be considered for this project but will be eligible for consideration on future GSA commissions alongside the other artists on the Registry.  Artists already on the Registry need not resubmit but may elect to update their information prior to the deadline.

GSA evaluates artists based on the following criteria: the media, materials, content and style of the artist’s past work, along with the artist’s past performance and experience with commissions or projects similar to the one described in this synopsis.

Shortlisted artists will be contacted and asked to submit additional information, including a statement that the artist can perform the work associated with the GSA commission within the identified budget.  GSA will count the combined weight of all the selection criteria as significantly more important than price.

At a minimum, the scope of services for this commission will require collaboration with the lead designer selected for the building project; development of preliminary and final concepts; fabrication of the artwork; participation in meetings and conservation reviews as necessary; and the installation of the artwork at the project site.

GSA will prioritize commissioning artworks in accordance with 41 FMR 102-77.21.

The U.S. Army Corps of Engineers – New England District is issuing a Solicitation Notice for Procurement and Replacement of a Log Boom at North Hartland Lake, North Hartland, VT. 

THE WORK CONSISTS OF:  Furnish all labor, materials, and equipment necessary to perform the following work at North Hartland Lake. 

Procure and Replace the Following:

  • Log boom wire rope with one inch (1”) diameter continuous length, six by nineteen (6 X 19) galvanized, Extra Improved Plow Steel (EIPS), Independent Wire Rope Core (IWRC), approximately twenty- three hundred feet (2300’) in length.
  • Twenty (20), twenty foot (20’) long boom logs
  • Forty (40) log boom chains
  • Twelve (12) one inch (1”) rope clamps
  • Two (2) one-inch (1”) thimbles
  • The Contractor shall remove existing wire rope, deteriorated logs marked for removal, and used hardware (chains, clamps, and thimbles) to dispose of properly off site.
  • The Government may exercise an option for the supply and delivery of five (5) additional twenty foot (20’) long booms to designated on site storage area.
